These Terms of Service govern your use of shirleyandislandwattle.com.au and the services provided by Shirley & Island Wattle. Product purchases are also governed by our Terms of Sale.

1. Eligibility

You must have the legal capacity to enter into a binding agreement. If you use the website for an organisation, you confirm that you are authorised to bind it.

2. Permitted use

You may use the website only for lawful purposes. You must not:

• use it fraudulently or unlawfully;
• interfere with its operation, security or accessibility;
• introduce malware or malicious code;
• scrape or extract content through unauthorised automated means;
• attempt to access systems or accounts without permission; or
• infringe intellectual property, privacy or other legal rights.

3. Accounts

You are responsible for supplying accurate information, protecting your credentials and notifying us promptly of suspected unauthorised activity. We may restrict an account where reasonably necessary to investigate misuse, protect customers or comply with law.

4. Product information

We make reasonable efforts to display products, prices and availability accurately. Colours and appearance may vary because of screen settings, lighting, manufacturing variations or natural materials. Measurements are approximate unless stated otherwise.

We may correct errors. If a material error affects an order, we will notify you and provide any option or remedy required by law.

5. Intellectual property

The website’s text, graphics, photographs, branding, design and software are owned by or licensed to Shirley & Island Wattle and protected by applicable laws.

You may view or print reasonable portions for personal, non-commercial use. No other licence is granted without prior written permission.

6. Reviews and submitted content

When submitting a review, image or other content, you confirm that it is lawful, accurate and non-infringing. You grant us a non-exclusive, worldwide and royalty-free licence to use and display it in connection with our business, subject to applicable privacy law.

We may remove content that is unlawful, abusive, misleading, irrelevant or infringes another person’s rights.

7. Third-party services

The website may use or link to independent third-party services. We do not control their availability, content or practices, except to the extent responsibility cannot legally be excluded.

8. Website availability

We do not guarantee uninterrupted or error-free access. We may maintain, modify or temporarily suspend website features when reasonably necessary.

9. Liability

Nothing in these terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

To the extent permitted by law, Shirley & Island Wattle is not responsible for indirect or consequential loss that was not reasonably foreseeable. This limitation does not apply to fraud, wilful misconduct, personal injury caused by negligence or liability that cannot lawfully be limited.

10. Governing law

These terms are governed by the laws of Queensland and the applicable laws of the Commonwealth of Australia. Mandatory consumer protections remain unaffected.

11. Changes

We may update these terms prospectively. The version applicable when an order is placed will govern that transaction unless a change is required by law or expressly accepted by you.
